TERMS & CONDITIONS
Welcome to Rocca Life Membership Club based at lucyroccalifecoaching.com (the “Site”) Please read these Terms of Service (the "Terms") carefully because they govern your use of our Site and our services accessible via our Site. To make these Terms easier to read, the Site and our services are collectively called the "Services.”
WHO MAY USE THE SERVICES
ELIGIBILITY
You may use the Services only if you are 18 years or older and capable of forming a binding contract with Rocca Life Membership Club and are not barred from using the Services under applicable law.
CLUB TERMS & CONDITIONS
1. CLUB NAME
The name of the club is “Rocca Life Membership Club” (the “Club”), conducted at the relevant Premises (as defined below). The Club is a proprietary club, owned and operated by Lucy Rocca “The Proprietor”.
2. CLUB RULES
These Club rules (the “Rules”) set out the terms and conditions of membership and have been created to safeguard the use and enjoyment of the Club by its Members.
3. CONFIDENTIALITY
The Club’s management adheres to the strictest confidentiality standards and pledge to maintain all records and personal information concerning the members in the strictest confidence. For more information on document retention please see our Privacy Policy.
4. OBJECTIVES OF THE CLUB
The objective of the Club is the provision of facilities and amenities of a club for the purpose of: allowing likeminded people to connect and interact in a safe, online space with the shared intention of living an alcohol-free life.
5. THE CLUB
The Club premises are located at Brookhouse Hill, Sheffield, S10 3TE, England as well as any premises in which the Club operates, together the “Premises”.
The Proprietor is responsible for providing the Club at the Premises and all necessary facilities for carrying on the Club in accordance with the Objectives of the Club and these Rules.
A Member shall be entitled to all the rights and privileges of the Club and shall be bound by these Rules but shall have no proprietary rights in any of the premises or in respect of property of the Club and the Proprietor.
6. BECOMING A MEMBER
Every candidate for Membership must be at least 18 years of age. Membership to the Club is automatic upon payment of either a six-month or twelve-month subscription. Membership Fees must be paid via our online system using a credit or/ debit card or alternatively by direct debit. Membership Fees must be paid in one of the following ways: by making a one off annual payment, by making two biannual payments (a payment every six months; or by monthly direct debit or payments. All payment details will be kept confidential. A list of the names, email addresses and postal addresses of all Members of the Club must be kept on the Club premises. All personal information is kept in compliance with our Privacy Policy.
7. CANCELLING A MEMBERSHIP APPLICATION
Following payment of the Fees, Members will have 14 calendar days during which they may withdraw their application without incurring any cost (the "Cooling-Off Period"). During the Cooling-Off Period and following written confirmation of withdrawal for Membership, the Member will be entitled to the return of their Fees. Where a Member wishes to cancel their Membership following expiry of the Cooling-Off Period the Fees will not be refundable. To cancel or withdraw any Membership, a Member must write to coaching@lucyroccalifecoaching.com with a written request to cancel. Membership will cease one month after the written request to cancel has been received.
8. THE MEMBERSHIP
Members can elect to sign up for either (i) a twelve month Membership; or (ii) a six month Membership. Membership benefits include a free journal, monthly (Sunflower package) or bi-monthly (Blossom package) group 1-hour coaching sessions conducted via Zoom, bi-monthly email support, and 1-hour private coaching with Lucy Rocca (only included in the Lotus package).
9. MEMBERSHIP FEE
The Membership Fees shall be fixed by the Proprietor. The Proprietor may, at its discretion, waive or reduce the subscription of any Member. The Annual Membership Fee is due immediately upon renewal. Candidates can enquire about the Annual Membership Cost or any other Membership question by contacting coaching@lucyroccalifecoaching.com
10. FREE JOURNAL
Members will be requested to provide a postal address upon joining the Club in order to receive the free Lucy Rocca Life Coaching journal. This gift is included in all packages.
11. SUSPENSION
The Club reserves the right to suspend the Membership of any Member at any time and for any action or behaviour that detrimentally affects the group as a whole.
12. CONDUCT OF MEMBERS
The Club shall have the right to refuse any Member access to the group sessions. All Members are required to maintain an acceptable standard of behaviour, conducive and appropriate to the Objectives and quality of the Club. If the Club withdraws a Member’s Membership for any of the reasons set out in these Rules, the Club will retain Fees already paid.
13. EXPULSION OF MEMBERS
The Club may expel from the Club (and subsequently terminate or suspend from Membership for a specific period) any Member whose conduct during group sessions or individual coaching sessions is deemed unacceptable (see below). For the avoidance of doubt, the following (non-exhaustive) list of behaviour or offences will lead to the immediate expulsion of a Member from group and individual sessions and may lead to suspension or termination of their Membership: violent, abusive or intimidating conduct; sexual, racial or any other form of discrimination, harassment or bullying towards any other Member or employee of the Club; rudeness or bad language to a Member or any action likely to bring the Club into disrepute. Before a Member is suspended or her Membership terminated, the alleged offender’s conduct shall be inquired into and the person involved shall be given the opportunity to defend herself and to justify or explain her behaviour. Having inquired into the events, if the Proprietor is of the opinion that the Member is guilty of such conduct as mentioned above and has failed to justify or explain it satisfactorily, the Proprietor may either suspend or terminate the Membership of the offender at its discretion.
14. TIMES OF GROUP COACHING SESSIONS AND PRIVATE 1:1 COACHING SESSIONS
The group sessions will take place via Zoom Fortnightly (Blossom and Lotus) or Monthly (Sunflower) and the private 1:1 Coaching Sessions will be arranged on an individual basis between Lucy Rocca and the Member. Members will be informed of any changes to the agreed times and dates of all sessions in advance. Where Members miss sessions, these will not be refunded. Where unavoidable circumstances result in a group or individual coaching session being cancelled by the Proprietor, the missed session will be rescheduled within the shortest time frame possible and all Members will be informed of the rearranged time and date.
15. ALTERATION OF RULES
These Rules may be revoked, supplemented or altered by the Club or its representatives or employees with authority to do so at any time at its sole discretion. Any such revocation, alteration or addition shall be deemed to have been brought to the notice of Members provided that a copy thereof is prominently displayed on the Club’s official website.
16. DISSOLUTION
The Club may be dissolved by the Proprietor at any time at its sole discretion. Under these circumstances no return of the Fees shall be due to any Members whatsoever, and all debts owed to the Club and/or Proprietor become due immediately.
17. DISPUTES & INTERPRETATION
Any dispute or difference which may arise in respect of these Rules and/or in relation to Membership or operation of the Club shall be determined by Lucy Rocca, whose decision shall be final and binding on all Members. These Rules shall be governed and construed in accordance with English law and Members and guests agree to submit to the exclusive jurisdiction of the courts of England.
